O R D E R

The petitioner, who was arrested and remanded to judicial custody on 21.07.2024 seeking bail in connection with the case in Cr.No.15 of 2024, registered for the offence under Sections 8(c), r/w 20(b)(ii)(c), 29(1), 25 of

the NDPS Act, 1985

2. The case of the prosecution is that on a specific information, the Officers of the respondent seized 258.300 kgs of ganja. It is alleged that the petitioner along with accused were involved in illegal transportation of 258.300 kgs of ganja in the vehicle. Hence, the case.

3. The learned counsel for the petitioner submitted that the co-accused in this case was granted bail. He further submitted that no contraband was recovered from this petitioner and only based on the confession of the coaccused this petitioner has been falsely implicated in this case. Hence, prays to grant bail to the petitioner.

4. The learned Government Advocate appearing for the respondent submitted has filed a counter wherein it was stated that when the petitioner along with A1 was transporting ganja in the vehicle, the property was recovered. He further submitted that the petitioner belongs to Kerala and when he was transporting from Odissa to Ramanathapuram, the contraband was seized. Further the statement of the petitioner was also recorded,

wherein, it was stated that the relative of the petitioner will bring ganja from Odissa and give it to the petitioner and he will sell the same.

5. Heard both sides and perused the materials available on record.

6. On a perusal of the statement recorded from the accused he himself has admitted that they procure the ganga from his relative and sell the same. Hence, this Court is not inclined to grant bail to the petitioner. Accordingly this petition is dismissed.
