Petition praying that in the circumstances stated therein and in the affidavit filed therewith the High Court will be pleased to direct the Respondents to consider the petitioner for promotion to the post of Associate Professor, in (WMP No.3731/2017 in WP NO.3668/2017).
Order : This petition coming on for orders upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of M/S. M.VENKATACHALAPATHY Senior council for M/S.A.SELVENDRAN, Advocate for the petitioner and of M/S. ABDUL SALEEM Advocate for 1 to 5 the Respondents the court made the following order:- The Disciplinary Authority, vide order dated 05.08.2016 has imposed the punishment of reduction of pay to a lower stage in the same scale for a period of one year, for his misbehaviour and also treated the period of suspension as duty. The petitioner challenging the said order, filed an appeal and it was also dismissed on 04.01.2017 and challenging the order passed by the Appellate Authority, the present Writ Petition is filed. 2.The petitioner, pending disposal of the Writ Petition, prays for promotion to the post of Associate Professor. In the considered opinion of the Court, the currency of punishment is in subsistence and further that the prayer sought for by him traverse beyond the prayer in the main Writ Petition.
