ORDER

The petitioner is the husband. He filed HMOP No.394 of 2014 for divorce before the Sub Court, Tambaram.

2. The respondent-wife filed OP No.4813 of 2014 before the Principal Family Court at Chennai for restitution of conjugal rights.

3. Now the petitioner sought to transfer his HMOP No.394 of 2014 from Sub Court, Tambaram to the Principal Family Court, Chennai to try along with O.P.No.4813 of 2014 filed by his wife.

4. In view of such a prayer, I am of the view that no notice is necessary to the respondent since no prejudice would be caused to the respondent if the HMOP No.394 of 2014, filed by the petitioner, is transferred from the Sub Court, Tambaram to the Principal Family Court, Chennai, wherein the respondent-wife filed her OP No.4813 of 2014. 5. Accordingly, this Transfer Civil Miscellaneous Petition is allowed. No costs. Consequently, connected miscellaneous petition is closed.
