The Administrator General and Official Trustee has filed the instant application seeking permission to donate a sum of Rs.4,17,329/- from the accumulation funds of the financial year 2019-20 of the Trust Estate of C.Kandasamy Naidu to the Correspondent of Madras Tamil Mission School, Sathangadu, Chennai for repairing, repainting work of class room, kitchen, compound wall and toilet.
2. In support of the Judge's Summons, the Administrator General and Official Trustee has filed his report dated, 24.04.2024, which reads thus:- 1.The AG & OT submits that the office of the Administrator General and Official Trustee of Tamil Nadu has been administering more than 150 Trust Estates. There are properties to Trust Estates and rental income derived from them are invested in fixed deposits. Out of the rental and interest income, the O/o AG & OT has been doing charities as directed by the testator such as maintenance to the beneficiaries, scholarship to the students, salary to estate staff, paying statutory charges to government, paying income tax and meeting other necessary expenses. Apart from that, as per the orders of the Hon'ble High Court donation by way of money, things, articles and medical equipment's etc., have been made to various NGOs and other religious and non-religious institutions based on their request.

It is submitted that the Trust Estate of C.Kandasamy Naidu is one among the trust estates which is vested with this office as per the last Will of the testator dated 21.05.1948 [D1], and as per the letters of administration of the Hon'ble High Court in O.P.No.278 of 1948 dated 05.10.1948. The Trust Estate of C.Kandasamy Naidu has various properties and fixed deposits. Out of the income generated from them charities are being done as per the Will of the Testator and the orders of this Hon'ble Court.

3. It is submitted that the Head Mistress of Madras Tamil Mission Primary School - Sathangadu and the Correspondent Mr. V.D.S. Inbanathan have sent a request letters dated 04.04.2024 and 22.04.2024 respectively, to the office of the Administrator General and Official Trustee of Tamil Nadu seeking financial assistance to repair the class rooms. It is submitted that the said school is Government aided and belongs to Madras Tamil Mission charities, which is under the control of AG & OT. There is no sufficient fund in Madras Tamil Mission charities and hence, this office proposes to donate the requisite fund to school from C.Kandasamy Naidu Charities. In this school there are about 60 students are studying and all belong to poor family. The Copy of the request letters alongwith quotations are Marked as Exhibit D2.
4. It is submitted that, they requested for the following repair work in the school building.
· To repair the class room which is damaged due to water leakage on the roof.
· To repair the kitchen room which is damaged due to water leakage. · To repair the damaged toilets for the children · To repair the inner side of the damaged compound wall. And painting the block boards and walls.
5. It is submitted that, they have also submitted quotations for the works to be done in the school. They are as follows. Sl.

It is humbly submitted that, the object and purpose of the trust is not opposed to such donations to school. From among the above quotations, the least one is Rs. 4,17,329/- (Rupees Four Lakh Seventeen Thousand Three Hundred and Twenty Nine only). Therefore, office of AG & OT is inclined to choose the least quotation referred above.

3. Heard the submissions made by the Administrator General and Official Trustee and perused the materials available on record.
