Respondents Prayer: Writ Petition filed under Article 226 of the Constitution of India, seeking for a writ of mandamus directing the 1st respondent to consider and dispose of the petitioner's appeal dated 27.02.2012 by giving sufficient opportunity to the petitioner as well as the parties are concerned. ORDER
By consent, the writ petition is taken up for final disposal.
The petitioner claims that he is the absolute owner and is in possession and enjoyment of the land admeasuring to an extent of 1215 sq.ft. with superstructure thereon, bearing Door No.5, Vembuli Pannaikkaran Street, comprised in Survey NO.70, of Ullagaram village, Sholinganallur Taluk, Kancheepuram District and he would further state that since some of the persons, viz., Tvl. Krishnan and Murugan, started interfering in the peaceful possession and enjoyment of the property, he filed a suit in OS.No.919/2004 on the file of the Court of District Munsif,
Alandur and it was decreed on 18.08.2005 and despite that, the 4th respondent herein has created a general Power of Attorney as if the above said two persons are the owners of the said property. Neither Tvl. Krishnan nor Murugan have title and therefore, they cannot authorise anybody to act on behalf of them. The petitioner in this regard, has submitted a representation dated 17.11.2011 to the 2nd respondent and vide order dated 16.02.2012, the 2nd respondent rejected the said representation on the ground that it lacks jurisdiction to entertain the said complaint/representation. The petitioner, aggrieved by the said order of the 2nd respondent dated 16.02.2012, filed an appeal before the 1st respondent dated 27.02.2012 and since no orders have been passed, the petitioner came forward to file the present writ petition. Heard the learned counsel for the petitioner and Mr.R.Govindasamy, learned Special Government Pleader, who accepts notice on behalf of the respondents.
This Court, without going into the claim projected by the petitioner either in this writ petition or in the appeal, permits the petitioner to submit one more reminder to the 1st respondent, praying for early disposal of the said appeal, within a period of two weeks from the date of receipt of a copy of this order and the 1st respondent, on receipt of the same, is directed to consider the said representation and dispose of the appeal in accordance with law, as expeditiously as possible, preferably within a further period of six weeks thereafter and communicate the decision taken, to the petitioner as well as to the persons concerned.
The writ petition is disposed of with the above direction. No costs.
