By consent of the parties, the civil miscellaneous petition is taken up for hearing.

2. Since the preliminary decree for partition has been passed in favour of the respondents 1 and 2, there shall be an order of interim stay of passing of final decree alone. It is made clear that the other proceedings in final decree application may go on.
