ORDER
(Order of the Court was made by S. M. Subramaniam J.) The writ of declaration has been instituted to declare the complaint in SHRC No.13340/22/58 of 2021 pending on the file of the first respondent Commission.
2. When the Human Rights commission is in the process of adjudicating the issues on merits and by following the procedures, the writ petition filed seeking declaration to nullify the complaint is not entertainable. The grounds raised in the writ petition are to be raised before the Commission for the purpose of effective adjudication. Contrarily, the petitioner has filed the writ petition in order to prolong and protract the issues, which cannot be encouraged by this Court.
3. Thus, the writ petition is devoid of merits and stands dismissed. There shall be no order as to costs. Consequently, the connected miscellaneous petition stands closed.
