Respondents Prayer: Petition filed under Article 226 of the Constitution of India seeking a writ of Mandamus directing the 1st respondent to take action on the petitioner representation dated 22.02.2020. ORDER
(Made by the Hon'ble Chief Justice) None appears for the petitioner. We have heard Mr.P.Ayyaswamy, learned counsel for the respondents 1 and 2, Mr.T.K.Saravanan, learned Government Advocate for the respondents 3 and 4 and Mr.T.D.Selvan Babu, learned counsel for the fifth respondent.
2. On 11.12.2023, this Court passed the following order: "(1) the writ petition is filed by a former employee of the 5th respondent, alleging that the medicines
manufactured by the 5th respondent is without standard or quality and also hazardous to the human health and taking into consideration of the same, this Court has ordered notices to the respondents and also private notice and ordered listing of the matter on 12.10.2020.
(2) Mr.Ar.L.Sundaresan, learned Senior Counsel appearing for the 5th respondent made a mention and would submit that inspection has been caused by the concerned respondents and they have given a clean chit and even without any interim order of restraint, the 5th respondent - Laboratory is not allowed to function and prays for appropriate orders.
(3) Mr.M.Elumalai, learned Additional Government Pleader appearing for respondents 3 and 4 would submit that a joint inspection has been caused and the inspection did not revel any infraction on the part of the 5th respondent.
(4) In the light of the same, there may not be any impediment by permitting the 5th respondent to commence its operation and it is also subject to strict compliance of the relevant Norms, Rules and Regulations and Statutes.
(5) Therefore, the Director of Drug Control, is directed to pass appropriate orders in the light of the Inspection Report as expeditiously as possible
and not later than one week from the date of receipt of a copy of this order / uploading of the order in the website and communicate the decision taken, to the petitioner as well as the 5th respondent.
(6) Call on 25.02.2021."
3. Today, none appears for the petitioner.
4. Learned counsel for the petitioner has filed memo withdrawing the vakalatnama.
5. The writ petition, as such, is dismissed. There shall be no order as to costs.
