Petition under Article 226 of the Constitution of India praying for issue of a Writ of Mandamus directing the respondent to consider admission of the petitioner based on his cut-off marks in one of the University Departments of the respondent in CEG Campus, ACT Campus and MIT campus for the course EEE (Electrical and Electronics Engineering).

The petitioner applied for Engineering Course and he was allotted a seat in a Private Engineering College, Sriperumbudur. However, he did not join the said college. Due to the confusion regarding the applicability of NEET examination marks, for the State of Tamil Nadu, the counselling for medical seats got delayed. The belated counselling conducted for Medicine rendered many Engineering seats vacant as many students, who joined Engineering before the counselling done for Medicine, left the course and joined Medicine. Therefore, the petitioner, who has been allotted a seat in Sri Venkateswaraa College of Technology, Sriperumbudur, in the counselling held on 25.07.2017 seeks a direction to the respondents to consider his admission based on his cut-off marks in one of the University Departments of the respondent in CEG Campus, ACT Campus and MIT campus in Electrical and Electronics Engineering Course.

It is evident from the records that the last date for Engineering admissions is 15th August, of the relevant year as per the schedule prescribed by the Honourable Supreme Court in the judgment rendered in Parshavanath Charitable Trust & Others V. All India Council for Technical Education & Others (CDJ 2012 SC 892). As stated above, due to change in circumstances, with regard to applicability of NEET marks for medical admissions, many Engineering seats became vacant subsequently. Therefore, the University moved the Supreme Court and obtained extension of time till 30.08.2017. However, the writ petition itself has been filed only on 21.09.2017 on which date even the extended time granted for admission to Engineering Colleges by the Honourable Supreme Court had expired. Therefore, the petitioner cannot be granted any relief.

It is true that Anna University could have conducted subsequent counselling when the counselling was over on 19.08.2017 itself, well before the last date ie., 30.08.2017, this Court cannot expect the University to conduct counselling again. In any event, the last date upto which students could be admitted to Engineering Colleges is already over and therefore, the relief sought by the petitioner cannot be granted. The writ petition fails and the same is dismissed. No costs.
