ORDER

The petitioner herein is the wife and the respondent is the husband. The respondent/husband filed I.A.No.62 of 2015 in M.O.P.Sr.No.139 of 2015, on the file of the Family Court, Puducherry, to waive the period of one year condition and to grant leave to present the Petition for divorce. Now, the petitioner has filed the present transfer petition to transfer I.A.No.62 of 2015 to the Sub Court, Ponneri, Thiruvallur District.

Heard both sides.

Considering the law laid down by the Hon'ble Supreme Court that in matrimonial matters the convenience of the wife has to be taken into consideration, in transferring the case, I am of the view that I.A.No.62 of 2015, filed by the respondent has to be transferred to the file of Sub Court, Ponneri, Thiruvallur District.

4. In the result, the Transfer Civil Miscellaneous Petition is allowed and the Family Court, Puducherry, is directed to transfer the Application in I.A.No.62 of 2015 in https://hcservices.ecourts.gov.in/hcservices/

M.O.P.Sr.No.139 of 2015, pending on its file to the Sub Court, Ponneri, Thiruvallur District. No costs. Consequently, connected miscellaneous petition is closed.
