A.No.2391 of 2024 in O.P.No.528 of 2023 C.V.KARTHIKEYAN, J The respondent in the Original Petition who had not filed counter affidavit in the Original Petition seeking modification of the order dated 18.04.2024.

2. By the order dated 18.04.2024, the petitioner in the Original Petition was permitted to visit the child in the residence of this applicant/ respondent in the Original Petition between 6.00 p.m and 8.00 p.m on every Thursdays, Fridays and Saturdays.

3. It has now suddenly dawned on the applicant/ respondent in the Original Petition that she has to take her parents to Guruvayur for treatment. This fact was not informed this Court on 18.04.2024, when, in the presence of the counsels, the said arrangement was made. Even though, the Court should view the application seeking modification very seriously, since it seems to have been filed as an after thought and seeks for practically washing away the permission given a right through the month of May, the learned Senior Counsel on behalf of the applicant/ respondent in the Original Petition states that the visit to Guruvayur would be restricted between 30.04.2024 and 14.05.2024. This would effectively mean that the petitioner in the Original Petition would be deprived of interacting with the child on 2, 3, 4 and 9, 10, 11 of May, 2024 which are the Thursdays, Fridays and Saturdays.

4. The learned counsel for the respondent/ petitioner in the Original Petition is also present and he had not raised much objections to this remodification. https://www.mhc.tn.gov.in/judis 1/2

5. A direction to the petitioner in the Original Petition that the permission to visit the child in the residence of the applicant/ respondent in the Original Petition on every Thursdays, Fridays and Saturdays would commence from 16.05.2024 onwards.

6. This Application stands allowed.
