ORDER

The petitioner, who was arrested and remanded to judicial custody on 26.02.2026 for the alleged offences under Section 103(1) of B.N.S. @ 191(2), 296(b), 103(1) read with 61(2) of B.N.S. in Cr. No.47 of 2026 on the file of the respondent police, seeks bail.

2. The case of the prosecution is that the petitioner along with A1 conspired together and murdered the victim, who is the brother of the defacto complainant and hence the case.

3. The learned counsel for the petitioner would submit that there are about 5 accused and the petitioner herein is A2, the son of the deceased. He would further submit that he has been falsely implicated in this case and he has been under incarceration since 26.02.2026 and hence prayed to enlarge the petitioner on bail.

4. At this juncture, the learned Government Advocate (Criminal side) appearing for the respondent police would strongly objected the bail application stating that investigation is at preliminary stage and he would further submit that if the petitioner is enlarged on bail, it would jeopardise the investigation.

5. I have given anxious consideration to the submissions made by the learned counsel on either side.

6. The contention of the learned Government Advocate cannot be ignored. Considering the totality of circumstances and upon the fact that the investigation is at preliminary stage, this Court is not inclined to enlarge the petitioner on bail at present.

7. Accordingly, this Criminal Original Petition is dismissed. 09-04-2026 MJS Note:
