ORDER
The petition has been filed to summon the Civil Assistant Surgeon, Government Hospital, Perambalur, to produce the original Accident Register(s) pertaining to petitioners/appellants 1 and 3.
2. According to the learned counsel for the petitioner(s)/appellant(s), the prosecution had suppressed the fact that the appellants were injured in the occurrence and also the complaint given by them. He produced the copy of the Accident Registers pertaining to the appellants 1 and 3.
3. Learned Government Advocate (Crl.Side), based on the written instructions given by the Inspector of Police attached to the respondent, submitted that it is a fact that A1 and A2 were also injured; that they suffered only simple injuries and hence, the non-explanation of those injuries is not fatal to the prosecution.
4. However, the learned Government Advocate (Crl.Side) fairly produced the certified copies of the Accident Registers and submitted that
they are genuine and that the prosecution has no objection to mark the same under Section 391 of the Criminal Procedure Code (Cr.P.C), 1973.
5. Since the genuineness of the documents is not disputed and the respondent has produced the certified copies of the extract of the Accident Registers, they are marked as Exs.C1 and C2, respectively. Accordingly, the Criminal Miscellaneous Petition is allowed 30-06-2025 (2/2) To The Inspector of Police, Padalur Police Station, Perambalur, Perambalur District.
