ORDER
(The case has been heard through video conference) The respondent has filed a counter today and the relevant paragraph No.5 is extracted as follows:- "Aqeel Ahamed in his voluntary statement dated 31.07.2020 has stated that he was using the mobile number 8667464180. During the course of investigation the details for the mobile number 8667464180 was ascertained from the respective mobile service provider. As per the reply provided by the Reliance Jio Infocomm Ltd, the mobile number 8667464180 is subcribered to Noorullah Pearae John, No.3/269 Pachaiyappar 8th Street, Periyar Salai, Palavakkam, Chennai-600 041. A summon dated 13.08.2020 under Section 67 of NDPS Act was issued to Noorullah Pearae John for his appearance in NCB Office before the Investigating Officer at 12.00 hrs on 21.08.2020. failed to appear. So second summon dated 26.08.2020 under Section 67 of NDPS Act to Noorullah Pearae, was issued to Noorullah Pearae John for his appearance in NCB Office before the Investigating Officer at 11.00 hrs on 27.08.2020. The said summon was served at the above address which was received by his wife. Based on the summon, the petitioner Noorullah Pearae John appeared at 11.00 hrs on 27.08.2020 and gave his voluntary statement in his own handwriting, in which, he has stated that he had procured the JIO number 8667464180 by providing his identity as requested by his owner K.M.Iqbal and further stated that his owner K.M.Iqbal accompanied him to Reliance Shop while purchasing the same and paid the charges for it. Noorullah Peare John identified the photo of Aqeel Ahamed and informed that he is grandson of his owner K.M.Iqbal."
2.The learned Special Public Prosecutor submitted that petitioner is employed under the father of the accused and the petitioner is no way connected in this case. Therefore he is not wanted in this case.
