O R D E R

This petition has been filed by the complainant to direct the first respondent to execute non-bailable warrant which was issued against the second respondent in C.C.No.2159 of 2016 on the file of the Fast Track Court, No.III, Saidapet ( Magistrate No. III).

2. The learned counsel for the petitioner has submitted that the petitioner herein has filed a private complaint under Section 138 of the Negotiable Instrument Act, against the second respondent and based on the said complaint, the case was taken on file in C.C.No.2159 of 2016 and summons was issued to the second respondent and on receipt of summons he appeared initially but subsequently, he did not appear and hence, nonbailable warrant has been issued on 22.06.2018, but, so far, the first respondent has not executed the said warrant. Hence, he requests to direct the first respondent to execute the said warrant at early.

3. The learned Additional Public Prosecutor who is appearing for the first respondent has submitted that the first respondent is searching for the second respondent and some reasonable time https://hcservices.ecourts.gov.in/hcservices/

may be given for executing the warrant.

4. Considering the aforesaid submissions, the first respondent is directed to take effective steps to execute the non-bailable warrant and secure the second respondent and produce before the Trial Court preferably within two months from the date of receipt of copy of this Order.

5. With the aforesaid direction, this petition is disposed of.
