For Petitioner : Mr.K.R.Laxman For Respondents : Mr.K.Tippu Sulthan Government Advocate COMMON ORDER These writ petitions have been filed for direction directing the first and second respondents to issue order to the third respondent to return the their original degree certificates and other documents which were deposited by the petitioner during their admission for their post
graduate course.

The petitioners, after completion of their degree in MBBS course, were qualified and were selected to their post graduate degree in the third respondent college during the academic year 2020-2024. While joining their post graduate degree in MD Anaesthesia & MS Obstetrics & Gynecology respectively, they had executed bond for a sum of Rs.40,00,000/- with undertaking to serve for the government of Tamil Nadu for the period of two years. However, by way of government order in G.O.Ms.No.351 dated 27.10.2023, the bond condition for the period of two years has been reduced to one year. Though the petitioners had completed their post graduate degree in the month June 2024, they were not given any posting order. However, the petitioners waited till the month of April 2025 and filed these Writ Petitions for return of original documents which were deposited by them at the time of admitting into the post graduate course.

On instructions, the learned Government Advocate appearing for the respondents submitted that both the petitioners were issued posting orders dated 13.12.2025 and the petitioner in W.P.No.13276 of 2025 was posted at Government Hospital, Kodaikanal,
Dindigual and the petitioner in W.P.No.13280 of 2025 was posted at Government Hospital, Rameswaram, Ramanadhapuram. Even then, both the petitioners failed to join their duty as per the posting orders. Therefore, the original certificates which were deposited by the petitioners at the time of their admission cannot be returned to the petitioners.

The learned counsel appearing for the petitioners submitted that even assuming that the posting order was issued to the petitioners, it was issued only after the period of six months. Therefore, that period should be deducted from the total bound period. He further submitted that the place on which the petitioners were now posted is not proper since, the petitioners had completed their post graduate course and as such it is not adequate for the petitioners to continue as per their qualifications. 5.
Heard the learned counsel appearing on either side and perused the materials placed before this Court.

It is seen that the posting orders were issued in the month of December, 2024. Considering the above facts and circumstances, the second respondent is directed to issue fresh posting orders to both the petitioners in the available vacancies within a period of one week from the date of receipt of a copy of this Order. Thereafter, both the petitioners shall join their duty as per the fresh posting orders, within a period of two weeks from the date of receipt of the posting orders and shall continue their service for the period of six months from the date of their joining. After completion of service, the respondents are directed to return all the original certificates viz., (1) Original 12th mark sheet (2) Original UG 4 years marks sheet (3) original UG Degree Certificate (4) Original PG Provisional (5) Original PG Mark Sheets, (6) Original PG Degree Certificate, to the petitioners.

With the above directions, the Writ Petition stands disposed of. Consequently, connected miscellaneous petitions are closed. There shall be no order as to costs.
