This writ petition has been filed for a direction to the 3rd respondent to register and release the Release Deed dated 01.12.2023 executed by the petitioner, which document was withheld by the 3rd respondent for deficit stamp duty.

2. Heard the learned Senior Counsel appearing for the petitioner and the learned Special Government Pleader appearing for the respondents and perused the materials available on record.

3. Learned Senior Counsel appearing for the petitioner would submit that since the release is between a non-member of the family, the petitioner is ready to pay the correct value as per Article 55 (Schedule I - stamp duty on instruments) of the Indian Stamp Act, 1899. 2/4

4. In such view of the matter, if the petitioner pays the difference value of stamp duty, the 3rd respondent shall release the Release Deed dated 01.12.2023 registered as document No.838 of 2023, within a period of ten days on receipt of the difference stamp duty by the petitioner. With the above direction, this writ petition is disposed of.
