ORDER

The petitioner apprehends arrest for the alleged offence under Sections 296(b), 329, 324(4), 324(5), 115(2), 118(1), 351(3), 303(2) of BNS r/w 4 of

TNPHWA Act, r/w 3(1)(s), 3(2)(va), 3(1)(r) of SC/ST Act in Crime No.47 of 2025 on the file of the respondent police seeks anticipatory bail.

2. The case of the prosecution is that, on 14.02.2026 at about 4.30 p.m, the petitioner trespassed into the defacto complainant's land and removed soil. When the same was questioned, a quarrel ensued, during which both sides attacked each other, causing injuries and damage to property. It is further alleged that the petitioner abused the defacto complainant in caste-based terms. Hence, the case.

3. Learned counsel for the petitioner submitted that the petitioner is an innocent person and has been falsely implicated in this case. He further submitted that no specific averments are made to attract the provisions of the SC/ST Act. Hence, he seeks anticipatory bail to the petitioner.

4. Learned Government Advocate (Criminal Side) appearing for the respondent police reiterated the prosecution's case and, on instructions, submitted that there is a specific reference to the community of the defacto complainant in the FIR, thereby attracting the provisions of the SC/ST Act.

5. In view of the prima facie materials available on record attracting the

provisions of the SC/ST Act, this Court is of the firm view, in light of the bar under Section 18 of the said Act, the present anticipatory bail petition is not maintainable.
