W.P.No.5860 of 2022 WMP No.13606 of 2022 in W.P.No. 5860 of 2022 D.KRISHNAKUMAR, J.

This Court by an order dated 16.03.2022, has granted interim stay, subject to the deposit of 50% of the Subsistence allowance, payable to the respondent.

2. This miscellaneous petition has been filed to modify the above order, inview of the fact that full subsistence allowance has been paid and no further subsistence allowance is payable to the respondents.

3. Inview of the above, the interim order passed by this Court in W.P.5860 of 2022 and WMP No.5958 of 2022 dated 16.03.2022 at paragraph No.4 is modified to that extent, as follows:

4. " 4. In view of the above, prima facie case is made out and there shall be an order of interim stay of operation of the preliminary Award passed by the Principal Labour Court, Coimbatore, dated 27.11.2020 in I.D.No.163 of 2005".

5. Accordingly, this petition is ordered.
