O R D E R

The present petition has been filed seeking a direction to the respondent to register the complaint of the petitioner dated 07.09.2015 and investigate the same in accordance with law.

2. In the petition it has been stated that more than 370 banners were erected at Radhakrishnan Salai and Kamarajar Salai in the name of Mr.Vijayabasker, a Minister of State of Tamil Nadu, without getting a permission of the District Collector and the said act on the part of the Minister is an punishable offence. Hence, the petitioner lodged a complaint dated 07.09.2015. Since, no action was taken on the said complaint, the present petition has been filed.

3. Heard the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor appearing for the respondent.

4. The learned Additional Public Prosecutor submitted that on receipt of the complaint C.S.R.No.418 of 2015 was assigned and now the matter is under investigation.

Considering the submissions made on either side, this Court is of the opinion that it is appropriate to direct the respondent to conduct an enquiry on the complaint dated 07.09.2015 given by the petitioner, if enquiry was not conducted so far and upon enquiry, if materials are gathered indicating commission of any cognizable offence, the respondent is directed to proceed further in accordance with law, as early as possible.
