This petition has been filed to direct the first respondent to register the case based on the complaint lodged by the petitioner dated 02.07.2018.
2. The learned counsel for the petitioner has submitted that the petitioner is the brother of one Kanni Ammal @ Mangai. The said Kanniammal @ Mangai has given Power of Attorney to the petitioner herein, who is her brother, to file this petition. He further submitted that Kanniammal @ Mangai is the owner of the property situated in Survey No.137/2 and Old Survey No.204/1 having an extent of 59 cents situated at Chettikuppam Village, Madhuracity Nagar, Marakkanam in Tindivanam Taluk, Villupuram District. He further submitted that petitioner came to know that the accused persons created some false documents and sold https://hcservices.ecourts.gov.in/hcservices/
the property and hence, the petitioner has lodged a complaint before the second respondent on 02.07.2018, but, so far no action has been taken.
3. The learned Additional Public Prosecutor has submitted that the said complaint is still pending for enquiry.
4. Considering the aforesaid submissions, the first respondent is directed to expedite the enquiry. If the enquiry reveals any cognizance offence, then, he has to register a case and proceed in accordance with law. In case, the enquiry reveals only a civil dispute, he has to direct the petitioner to approach the appropriate forum and get appropriate relief in accordance with law.
5. With the aforesaid directions, this Criminal Original Petition is disposed of.
