O R D E R

This petition has been filed seeking a direction to the respondent to register the petitioner's complaint dated 25.05.2015.

2. It is seen that, the petitioner is a Software Engineer who lodged a complaint on 25.05.2015 against one Ravichandran, Ananthi and Siva on the allegation of cheating him for a sum of Rs.5.86Lakhs, before the respondent police. On receipt of the said complaint, CSR has been assigned in CSR No.720 of 2015. Since there is no subsequent progress on the said complaint, this petition has been filed.

3. When the matter is taken up for consideration, learned Additional Public Prosecutor submitted that the matter was compromised between the parties and submitted a copy of the Report as 'further action dropped'.

4. Learned counsel for the petitioner submitted that the matter has been compromised and a cheque was given to the petitioner for a sum of Rs.7,00,000/- covering the principal and interest amount. At the time of receiving the cheque, the petitioner submitted a letter to the respondent stating that, not to proceed with the complaint https://hcservices.ecourts.gov.in/hcservices/

temporarily, till the cheque is honoured. But, when the cheque was presented, it was returned without being honoured. Hence, the present petition has been filed for a direction to the respondent to register a case based on the complaint given by the petitioner.

Since the action has been dropped on the complaint dated 25.05.2015, this Court directs the petitioner to give a fresh copy of the complaint, along with a copy of this order, within one week from the date of receipt of this order and on receipt of the same, the respondent is directed to enquire into the complaint and upon enquiry, if materials gathered indicates commission of any cognizable offence, the respondent is directed to proceed in accordance with law as early as possible, preferably within a period of two months.
