The petitioner, who was arrested and remanded to judicial custody on 07.04.2024 for the alleged offences punishable under Sections 294(b), 448, 324, 506 (ii) & 307 of IPC r/w Section 3 of Tamil Nadu Public Property (Prevention of Damage and Loss) Act, in Crime No.78 of 2024 on the file of the respondent Police, seeks bail.
2. Learned counsel appearing for the petitioner submitted that the petitioner (A1), aged about 25 years is an innocent person and he has been falsely implicated in this case. He further submitted that the petitioner is no way connected with the alleged offence and he is in custody from 07.04.2024. He also submitted that the petitioner is ready to abide by any stringent conditions that may be imposed by this Court. Hence, he prayed to grant bail to the petitioner.

Learned Government Advocate (Criminal Side) appearing for the respondent police raised objection for granting bail to the petitioner stating that due to the previous enmity between the petitioner's family and the de facto complainant's family, the petitioner along with other accused, trespassed into the house of the de facto complainant, abused him in a filthy language and attempted to murder him by assaulting him with deadly weapons and also damaged three two wheelers and house window. 4. Heard the learned counsel for the petitioners and the learned Government Advocate (Criminal Side) appearing for the respondent and perused the materials available on record.
5. Taking into consideration the facts and circumstances of this case and the submissions made by the learned Government Advocate (Criminal Side) and taking note of the fact that the investigation is still pending and also considering the nature and gravity of the offence committed by the accused, this Court is not inclined to grant bail to the petitioner.
