This Petition has been filed under Section 372 of the Indian Succession Act seeking Succession Certificate relating to debts of the mother of the petitioner, by name Tmt. Eben Joice Maragatham, who died intestate on 15.03.2021.

The petitioner is the only legal heir. The father of the petitioner had pre-deceased the mother and had died on 14.04.1991. The parents of the mother of the petitioner had also died. The petitioner has no other brothers or sisters. 3.

After following due procedure, the petitioner was invited to tender evidence. The petitioner examined himself as PW1. The death certificate of his mother and that of his father were marked as Exs. P-1 and P-2 and the legal heirship certificate of his mother was marked as Ex.P-3, the details relating to the post office savings banks account of his mother was marked as Ex.P-4. In view of the evidence presented, this Petition stands allowed as prayed for and a direction for grant of Succession Certificate to the petitioner with power to collect the debts and to receive the interest specified in the schedule is issued.
