Considering the averments made in the affidavit filed in support of the application, it is seen that the property subject matter of the suit is situated within the jurisdiction of this Court and the cause of action for the suit had arisen within the jurisdiction of this Court. The first defendant, whose resident is in St.Thomas Mount is outside the jurisdiction of this Court. Hence, the plaintiff seeks leave to institute the suit against the first defendant in this Court.

2. In view of the fact that the suit property is within the jurisdiction of this Court and the cause of action for the suit had arisen within the jurisdiction of this Court, this application is allowed permitting plaintiff to institute the suit against the first defendant in this Court.
