O R D E R

(This case has been heard through video conference) The petitioner, who apprehends arrest at the hands of the respondent police for the alleged offences punishable under Sections 6(4) Tamil Nadu Schedule Commodities (Regulation of Distribution through card system) order 1982 r/w section 7(1) (a) (ii) of the Essential Commodities Act 1955 in Crime No.120 of 2018, on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that on 01.11.2018 during the time of routine check up at Vellore to Krishnagiri NH Road near at Anginayanapalli Thabal Medu Branch road, there was an illegal transportation of 45 bags of PDS rice (each bag containing 50 kgs), totally 2250 kgs in one TATA 407 bearing Registration No.TN-01-T5802. On enquiry, it was found that the petitioner was the owner of the PDS rice, which is meant for supply to the consumers below poverty line and hence a case has been registered against her.

3. The learned counsel appearing for the petitioner would submit that the petitioner(A2) is an innocent person and she has not involved in any of the offence as alleged by the prosecution. Hence, he prays to grant anticipatory bail to the petitioner. https://hcservices.ecourts.gov.in/hcservices/

4. The learned Additional Public Prosecutor appearing for the respondent would submit that the petitioner was found in illegal transportation of 2250kgs of PDS rice and she is the owner of the rice. He further submitted that the petitioner is having three previous cases in similar nature. Hence, he vehemently oppose for the grant of anticipatory bail to the petitioner.

5. Taking into consideration the above facts and circumstances of the case and also considering the previous antecedents of the petitioner this Court is not inclined to grant anticipatory bail to the petitioner. Hence, this Criminal Original Petition stands dismissed.
