Prayer : This Transfer Civil Miscellaneous Petition has been filed under Section 24 of C.P.C to pass an order of transfer of HMOP.No.36 of 2014 pending on the file of Sub Ordinate Judge, Arni to the Family Court, Vellore.

JUDGMENT

The wife has come before this Court seeking to transfer the petition filed by the respondent/husband for divorce on the file of Sub Court, Arni, Thiruvannamalai District in HMOP.No.36 of 2014 to the Family Court, Vellore.

2. The marriage between the petitioner and respondent was celebrated on 22.05.2005. Due to some dispute, both of them are living separately and therefore, divorce petition in HMOP.No.36 of 2014 was filed by the respondent/husband before the Sub Court, Arani and to transfer the said petition to the Family Court, Vellore, the petitioner/wife has filed the present petition.

3. When the matter was called, both the parties are present and they categorically stated that they are not willing to live together and filed a Joint Memo of Compromise. As per the Joint Memo of Compromise, the respondent/husband has to pay a sum of Rs.6,50,000/- (Rupees Six Lakhs Fifty Thousand only), which amount has been paid today by the respondent/husband to the petitioner/wife. Hence, no useful purpose will be served by https://hcservices.ecourts.gov.in/hcservices/

keeping the HMOP.No.36 of 2014 pending on the file of Sub Court, Arani.

4. In view of the above developments, this Court grants divorce by consent dissolving the marriage between the petitioner and respondent celebrated on 22.05.2005. By this order, HMOP.No.36 of 2014 on the file of Sub Court, Arni stands disposed of. Transfer Civil Miscellaneous Petition is disposed of in the above terms. Consequently connected Miscellaneous Petition is closed. No costs.
