ORDER

The petitioner is the wife and the respondent is the husband. The respondent / husband filed M.O.P.No.126 of 2015 on the file of Family Court, Pondicherry, seeking divorce. The petitioner / wife resides at Cuddalore. Hence, she has filed this petition to transfer the petition in M.O.P.No.126 of 2015 to the file of District Court, Cuddalore.

2. It is admitted by both parties that M.C.No.29 of 2014 filed by the wife for maintenance is pending on the file of Chief Judicial Magistrate, Cuddalore. Hence, I am of the view, the M.O.P.No.126 of 2015 may be transferred to the file of the concerned Court at Cuddalore.

3. Considering the submissions made by both parties, I am inclined to transfer the M.O.P.No.126 of 2015 from the file of Family Court, Pondicherry to Family Court, Cuddalore and if no Family Court is constituted, to the Sub Court, Cuddalore. https://hcservices.ecourts.gov.in/hcservices/

4. Accordingly, this Transfer Civil Miscellaneous Petition is disposed of directing the learned Family Court Judge, Pondicherry to transfer the petition in M.O.P.No.126 of 2015 pending on his file to the file of Family Court Or Sub Court, Cuddalore as the case may be for disposal.
