Prayer: This petition is filed under Article 226 of the Constitution of India to issue a writ of Mandamus directing the Respondents to consider and dispose the representation made on 31.01.2024 by the petitioner and pass orders.

ORDER

By consent of both parties, this writ petition is taken up for final disposal at the stage of admission itself.

2. This petition is filed to seeking a writ of Mandamus directing the Respondents to consider and dispose the representation made on 31.01.2024.

3.The facts of the case is that the petitioner's husband is a freedom fighter and she is receiving freedom fighter pension through the state freedom fighter pension order dated 27.09.2023. The grievance of the petitioner is that she has made application on 06.06.2005 and she is entitled to receive arrears of pension from the date of application with the rate of 12% per annum. Hence, the petitioner gave a representation to the second respondent. However, the same was not considered till date. Hence, this petition.

4. The learned counsel for the petitioner submitted that it would be suffice if this Court issues a direction to the second respondent to consider the petitioner's representation and pass orders.

5. The learned Special Government Pleader appearing for the respondents submits that the representation of the petitioner will be considered on merits and in accordance with law.

6. For the foregoing reasons this Court without expressing any opinion on the merits of the case, directs the second respondent to consider the representation of the petitioner and pass appropriate orders in accordance with law within a period of eight weeks from the date of receipt of a copy of this Order.

7. With the aforesaid direction, this writ petition is disposed of. No costs. Consequently the connected miscellaneous petition is closed. 03.06.2024 Speaking order : Yes/No Index : Yes/No smn 3/5
