Prayer: Writ Petition filed under Article 226 of the Constitution of India, praying to issue a Writ of Mandamus, directing the 2nd respondent to initiate further action against the 6th respondent under Section 205 of the Tamil Nadu Panchayats Act, 1994, on the basis of the show cause notice issued to the 6th respondent by the 2nd respondent on 04.11.2023 and conclude the proceedings.

By consent of both sides, this Writ Petition is disposed of at the stage of admission itself.

This Writ Petition is filed to direct the second respondent to initiate action against the sixth respondent on the basis of the show cause notice issued to him and conclude the proceedings. 2/6

Heard the learned counsel for the petitioner and the learned Additional Government Pleader for the respondents 1, 2, 4 & 5 and the learned Additional Public Prosecutor for the third respondent and perused the materials available on record.

It is the grievance of the petitioner that despite the show cause notice issued pursuant to the enquiry conducted by the Vigilance and AntiCorruption Department, no further action has been taken by the second respondent as against the sixth respondent. Hence, he seeks a direction. 5.

Mr.P.Sathish, learned Additional Government Pleader for the respondents 1, 2, 4 & 5 on instructions would submit that they will proceed on the basis of the show cause notice on merits of the case. 6.

In such view of the matter, there shall be a direction to the second respondent to proceed and to see that the proceedings, which reaches his logical end and pass appropriate orders, on its own merits and in accordance with law, within a period of three months from the date of receipt of a copy of this order.

With the above direction, this Writ Petition is disposed of. No costs.
