O R D E R

This petition has been filed seeking a direction to the 2nd respondent to register FIR on the petitioner's complaint dated 07.09.2015.

2. It is the case of the petitioner that his friend J.Ashok requested him for a loan of Rs.54,00,000/- on the promise that he would invest the money in a business and return the same within short period. Believing the words of said Ashok, the petitioner gave Rs.54,00,000/-. When the petitioner asked about the repayment of money, the said Ashok threatened the petitioner with dire consequences. Hence, the petitioner lodged a complaint on 06.02.2012 against the said Ashok. The https://hcservices.ecourts.gov.in/hcservices/

said Ashok had given an undertaking before the 2nd respondent herein with regard to repayment of amount stating that he would repay the amount of Rs.10,00,000/- on 20.03.2013, Rs.10,00,000/- on 30.03.2013 and Rs.25,00,000/- on 30.05.2013. Pursuant to the said undertaking, he had paid Rs.10,00,000/- only. Hence, the petitioner lodged a complaint on 07.09.2015 but no action has been taken by the respondent police and hence, the petitioner filed this petition.

3. The allegation made in the complaint is purely civil in nature and the prayer sought for by the petitioner cannot be granted and this petition is dismissed. However, the petitioner is at liberty to work out his remedy in a manner known to law, if he is so advised.
