C O M M O N O R D E R The writ petitions have been filed seeking direction to the respondents to refund Rs.30,00,000/- and Rs.20,00,000/- respectively, payable to the petitioners towards refundable security deposit in the account of the petitioner Solar Power Plant HTSC Nos.039534390123 and 039534390124 respectively. 2.Heard the learned counsel appearing on either side. With the consent of both sides, the writ petitions are taken up for hearing at the admission stage itself.

3.It is the case of the petitioners that the petitioners made application to the respondents for establishment of MW Solar Power Plant under preferential tariff scheme for captive consumption as per TNERC's Solar Order No.5/2018 dated 28.03.2018 and paid a total sum of Rs.30 Lakhs and Rs.20 Lakhs respectively, towards refundable security deposit. Even after commissioning of the said solar power plants which was also certified by the respondent vide letter dated 08.04.2025, the refundable amount was not paid by the respondents, for which the petitioners made representation to the respondents, 3/6

however, there is no response. Hence, these writ petitions have been filed.

4.The learned counsel for the petitioners submitted that this Court in an identical issue in W.P.No.46508 of 2025 on 27.11.2025 had passed an order, wherein, it has directed the first respondent to refund the eligible amount to the petitioner therein with appropriate interest as provided in the contract, if there is no legal impediment, within a period of six weeks and prayed to extend the same benefits to the petitioners herein.

Considering the facts and circumstances of the case and in the light of the order passed by this Court as stated supra, there shall be a direction to the first respondent to refund the eligible amount payable to the petitioners with appropriate interest as provided in the Contract, if there is no other legal impediment in disbursing the same to the petitioners, within a period of six weeks from the date of receipt of a copy of this order.

6.With the above direction, the writ petitions are disposed of. No costs.
