C.S.No.424 of 2018 C.S.No.424 of 2018 KRISHNAN RAMASAMY, J., The learned counsel for the plaintiff would submit that he has taken steps to serve suit summons against the defendants 1 and 2 and affidavit of service to that effect has been filed. It is further stated that the suit summon as against the 1st defendant was returned as refused and the suit summon in respect of 2nd defendant returned due to the reason left. Therefore the learned counsel seeks permission of this Court to file application for substituted service as against the 2nd defendant.

2. Accordingly, the learned counsel for the plaintiff is permitted to file an application for substituted service in respect of 2nd defendant. Since 1st defendant has refused to receive the suit summon, this Court direct the registry to print the name of the 1st defendant and post the matter on 13.09.2019.
