ORDER

This Transfer Petition is filed by the respondent in HMOP.No.82 of 2015 on the file of the Sub Court, Sivagangai, to transfer the matter to the Family Court, Chennai.

2. None appears on behalf of the petitioner. Heard the learned counsel for the respondent.

3. The respondent filed the matrimonial proceedings in HMOP.No.82 of 2015 against the petitioner before the Sub Court, Sivagangai. The petitioner, on appearance, filed this petition for transfer.

4. The learned counsel for the respondent fairly submitted that the respondent has no objection for transferring the proceedings to a Court at Chennai.

5. The petitioner is a permanent resident of Chennai. According to the petitioner, it would not be possible for her to appear before the Court at Sivagangai, in view of her precarious condition. Even otherwise, the respondent has no objection to transfer the proceedings to a Court at Chennai.

6. In the result, the proceedings in HMOP is withdrawn from the file of Subordinate Court, Sivagangai, and is transferred to the Family Court, Chennai, for disposal on merits.

The Transfer Petition is allowed accordingly. No costs. Consequently, connected miscellaneous petition is closed. 09.09.2016
