O R D E R

The present criminal original petition has been filed seeking a direction to the 2nd respondent to register the complaint dated 15.05.2015 and enquire the matter in fair manner and file a final report in order to prosecute the accused within the time limit as stipulated by this Court.

2. In the petition, it has been stated that the entire family of the petitioner are jointly staying at No.1/512, Rajamath colony, Royakottai post, Dhenkanikottai Taluk, Krishnagiri District. On 21.01.2010, the marriage between one Padmapriya and brother of petitioner's husband namely, Gnanam was solemnised. Now, out of their wedlock, they are having a child namely, Janani Shri and now she is four years old. From the date of marriage, there were frequent quarrel between Padmapriya and Gnanam. giving any proper care and attention to the child, used to go to her parent's house. During that period, her husband Gnanam only had taken care of the child. The said Padmapriya was working as a Professor in the college. On 15.05.2015, the petitioner along with her children and the child Janani shri went to attend the puberty function of their relation. At about 11.45 hours, one Sathyapriya came along with four gundas and assaulted her children by showing knife and attempted to kidnap the child namely, Janani shri. But people gathered there had rescued them. Therefore, the petitioner gave a police complaint before the second respondent and C.S.R.No.147 of 2015 was assigned. Since no action has been taken on the complaint lodged by the petitioner, she has come forward with the present petition. 3.

Today, when the matter was taken up for consideration, learned Additional Public Prosecutor submitted that a counter complaint was filed by the father of Padmapriya viz., Sivalingam, for which, C.S.R.No.160 of 2015 was assigned. He further submitted that enquiry was conducted and the complaints were closed.

4.In view of the same, since both the complaints were already enquired and closed, nothing survives in this petition. Hence, the present criminal original petition is dismissed. The respondents are directed to furnish closure report to the petitioner.
