Respondents Writ Petition filed under Article 226 of the Constitution of India praying for issue of Writ of Certiorarified Mandamus calling for the records pertaining to the impugned disqualification slip issued by the 2nd respondent dated 05.08.2015 and quash the same as illegal and consequently direct the respondents to conduct fresh physical efficiency test.

ORDER

(Order of the Court was made by The Hon'ble Chief Justice) The grievance of the petitioner is that in the first chance of long jump, he would not be able to clear the minimum prescribed limit for Physical Endurance Test. As per the record of the Physical https://hcservices.ecourts.gov.in/hcservices/

Endurance Test, second chance was given to him as to the other candidates (only two chances are given) and the petitioner, however, committed foul.

2. The learned counsel for the petitioner states that the petitioner never took the second chance.

3. The aforesaid is contrary to the record of the marks given produced before us signed by two witnesses. Further, this is not even the case of the petitioner in the grounds of the petition where he states that he should have been permitted to "complete the second chance" as he did not touch the zero point in the long jump field. Thus, what has been contended is clearly an after thought as the petitioner was given the second chance. He unfortunately failed to meet the requirement in the first chance, while he committed foul in the second chance.

4. We are, thus, of the view that there is no reason to interfere with the order impugned.

5. The writ petition is dismissed. No costs. Consequently, M.P.No.1 of 2015 is closed.
