By consent of learned counsel on both sides, this writ petition is taken up for final disposal at the admission stage itself. 2.The present writ petition is filed praying for a writ of mandamus to direct the 3rd respondent to conduct an enquiry and issue patta in the name of the petitioner by removing the name of Narasimhan, whose name was wrongly entered during digitization of Revenue Records in Town Survey Land Register based on his representation dated 16.12.2024 and proceedings of the 1st respondent in O.Mu.No.J5/e2800076/2024 dated 12.02.2025 in respect of property comprised in S.No.170 - Part, New S.No.170/2, measuring an extent of 2425 sq.ft. situated at Ayanavaram Taluk, Chennai District. 2/6
3.It is submitted by the learned counsel for petitioner that the petitioner is the absolute owner of the above mentioned property. The subject property was settled by the petitioner's father in favour of petitioner vide Settlement Deed dated 05.02.2021, registered as Document No.1349 of 2021. It is further submitted that the petitioner submitted a representation dated 16.12.2024 before the 1st respondent seeking issuance of patta as well as removal of Narasimhan's name. However, till date patta has not been issued in favour of petitioner. Aggrieved by the same, the petitioner has filed this writ petition. 4.At the outset, it is submitted by the learned Additional Government Pleader for respondents that pursuant to the representation dated 16.12.
2024, the enquiry is underway before the District Collector and the same would be completed after hearing the petitioner as well as Narasimhan and thereafter, appropriate orders would be passed in accordance with law within a time frame to be fixed by this Court, which was agreed to by the learned counsel for petitioner. 5.
appropriate orders keeping in view the revenue records including its digitization within a period of 8 weeks from the date of receipt of a copy of this order, after affording the petitioner, Narasimhan and any other interested parties a reasonable opportunity of hearing. It is made clear that this Court has not expressed any views with regard to the merits of the case and it is open to the concerned respondent to consider the case on its own merits and in accordance with law.
