Prayer : Writ Petition filed under Article 226 of Constitution of India, for issuance of a Writ of Mandamus, directing the second respondent to consider the representation of the petitioner dated 27.04.2022, consequently direct the 2nd respondent to permit the petitioner to sign the cheques along with some other regular attending ward member of the Vadakuthu Village Panchayat to enable the petitioner to smooth functioning of the administration of the Vadakuthu Village Panchayat.

ORDER

Mr. Shahjahan, learned Special Government Pleader takes notice on behalf of the first to fourth respondents and Mr.S.Prabakaran, learned Government Advocate takes notice on behalf of the fifth respondent.

2. This Writ Petition is disposed at the time of admission after dispensing with a notice on the private respondent, as no adverse orders are proposed to be passed at this stage. Suffice to state that the representation of the petitioner dated 27.04.2022 with the second respondent is pending and has not evoked any response so far.

3. It appears that the petitioner and the sixth respondent belong to different community and therefore it is the case of the petitioner that the sixth respondent is not co-operating with the petitioner who is the president of Vadakkuthu Panchayat Village.

4. Considering the same, I am inclined to dispose the writ petition by directing the second respondent to consider the representation of the petitioner dated 27.04.2022, insofar as delegation of powers with regard to signing the cheque by any other persons other than the sixth respondent as per the Government order and rules and regulations. The second respondent is therefore directed to pass appropriate orders on merits and in accordance with law within a period of two weeks from the date of receipt of a copy of this order. Needless to state that before passing such order, petitioner and the 6th respondent shall be heard.

5. This Writ Petition stands disposed of with the above observations. No costs. Consequently, connected Writ Miscellaneous Petition is closed.
