This application has been filed under Order II Rule 2 of CPC seeking an order granting leave to institute a separate suit against the defendant for damages arising out the same cause of action.

2.Heard also the learned Senior Counsel on behalf of the respondent, who had entered appearance on caveat.

3.The suit has been filed seeking permanent injunction. It had been contended that the quantum of damages would have to be arrived at after taking into consideration various factors and at this stage, it could not be quantified.

4.In view of the above, leave is sought. Leave is granted. This application stands allowed.
