Writ Petition has been filed under Article 226 of the Constitution of India praying to issue a Writ of Certiorarified Mandamus, after calling for the records pertaining to the order in Letter No.26016/Pa Pi (Po)3/MTC/2016 dated 23.04.2016 from the 2nd respondent, quash the 1/4
same and consequently direct the respondents to provide the petitioner forthwith appointment on compassionate ground and other terminal benefits including a sum of Rs.1,50,000/- which is payable under Family Benefit Scheme.

The petitioner's husband was a Casual Labourer under the respondents-Corporation, who had expired on 30.10.2014. Her claim for compassionate appointment has been rejected by the respondents by the impugned letter dated 23.04.2016, stating that since her husband had not put continuous service of 240 days and he had worked for only 75 days as Causal Labourer, she would not fall under the category of a beneficiary under the Compassionate Appointment Scheme. 2.The service of the petitioner's husband as a Causal Labourer for 75 days is not under dispute. While that be so, the petitioner will not be 2/4
in a position to claim the benefits of the scheme and as such, there is no infirmity in the impugned order of rejection. 3.Accordingly, this Writ Petition stands dismissed. No order as to costs.
