This petition has been filed seeking a direction to the second respondent to register a case based on the complaint of the petitioner dated 20.07.2015 and investigate the same in accordance with law.
2.It is seen that the petitioner is residing at No.25, P.K.Mesthiri Street, New Colony, Saidapet, Chennai 600 015. The petitioner and one Shanthi had jointly purchased the properties at S.Nos. 104/3C-2, 84-1, 104/3C, 85/2A, 104/3B, 105/2, 109/1 and 108/6 at Singampoondi Village, Thellar Sub Registration District, Seiyaru Sub District, Vandavasi, Thiruvannamalai District by way of registered sale deed dated 19.06.2008. The petitioner is entitled for 5.94 acres out of the same. One Parameswari, who is none other than the mother of the petitioner, had registered a power of attorney on 06.07.2015 in Doc.No.1158 of 2015 on the file of the Sub Registrar, Thellar as https://hcservices.ecourts.gov.in/hcservices/
if the petitioner had executed the same in favour of the said Parameswari. The petitioner had never executed such power of attorney and the mother of the petitioner Parameswari by impersonation created a forged document. Hence, the petitioner has lodged a complaint to the respondents on 20.07.2015, but the same was not registered till date. Hence, the petitioner has come forward with the present criminal original petition. 3.Heard the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor appearing for the respondents and also perused the materials available on record.
4.Considering the submissions made on either side, this Court is of the opinion that the second respondent is directed to conduct enquiry based on the complaint of the petitioner dated 20.07.2015 and upon enquiry, if materials are gathered indicating commission of any cognizable offence, the second respondent is directed to proceed further in accordance with law, within a period of two months from the date of receipt of a copy of this order.
