Mr.U.Baranidharan,SGP Order This writ petition has been filed to direct the second respondent to refund the stamp duty in respect of the un-used stamp papers, which are the subject matter of the petitioner's representation dated 20.06.2025, within a time frame to be fixed by this Court.
2.According to the petitioner, the stamp papers, which are the subject matter of the petitioner's representation are unused and have now become useless. Hence, the petitioner seeks for refund of the stamp duty. The petitioner had given a representation on 20.06.2025 to the second respondent for the aforesaid purpose. Since the said representation has not been considered, the petitioner has filed this writ petition.
3.Mr.U.Baranidharan, learned Special Government Pleader accepts notice on behalf of the respondents. He would submit that the representation of the petitioner is barred by limitation.
4.Learned counsel for the petitioner is disputing the same. He would submit that since the stamp paper was not put to use, the petitioner is entitled for refund.
5.This Court is not expressing any opinion on the merits of the respective contentions.
6.No prejudice would be caused to any of the parties if the petitioner's representation, as stated supra, is considered, on merits and in accordance with law, within a time frame to be fixed by this Court.

8.For the foregoing reasons, this writ petition is disposed of by directing the second respondent to pass final orders, on merits and in accordance with law on the petitioner's representation dated 20.06.2025 seeking for refund of the stamp duty in respect of the un-used stamp papers, within a period of 12 weeks from the date of receipt of a copy of this order.
