Writ petition filed under Article 226 of the Constitution of India, for issuance of a Writ of Mandamus, to direct the second respondent to allot 1 seat in the B.V.Sc. & A.H. Course for the academic year 2017-2018 for the in-service candidates working in the Animal Husbandry and Animal Welfare Department in Puducherry and consequently to direct the second respondent to admit the petitioner to the B.V.Sc.&A.H. Degree Courses for the academic year 2017-2018.

O R D E R

The petitioner seeks for a mandamus directing the second respondent to allot one seat in B.V.Sc. & A.H. Course for the academic year 2017-2018, for the in-service candidates working in the Animal Husbandry and Animal Welfare Department in Puducherry and consequently to direct the second respondent to admit the petitioner to the B.V.Sc.&A.H. Degree Courses for the academic year 2017-2018.

2. Heard the learned counsel appearing for the petitioner and the learned Additional Government Pleader (Puducherry) appearing for the first respondent.

3. The grievance of the petitioner is that in the prospectus issued for the academic year 2017-2018, the first respondent / Government has not included the reservation of seats for inservice candidates, even though, they have chosen to reserve the seats under various other categories. According to the petitioner, one seat has to be reserved for in-service candidates, which the Government failed to consider.

4. This Court, at this stage, is not inclined to express any view on the merits of the contention raised by the petitioner, that too after issuance of the prospectus, as it is for the first respondent to consider and decide for future, based on the representation made by the petitioner already on 24.05.2017, followed by another representation on 07.06.2017. It is stated that those representations are still pending and not yet disposed of. Therefore, without expressing any view on the merits of the matter, I only direct the first respondent to consider the said representations of the petitioner and pass orders on the same on its merits and in accordance with law, within a period of three weeks from the date of receipt of a copy of this order. No costs. Consequently, connected miscellaneous petition is closed.
