The petitioner is the wife and the respondent is the husband. The petitioner/wife has filed this petition, seeking transfer of HMOP No.278 of 2015 filed by the respondent/husband from Sub Court, Tambaram to Sub Court at Cuddalore.

2. Heard both sides.

3. It is admitted that there is a Family Court at Cuddalore. Under such circumstances, taking into account Section 19(iii)(a) of the Hindu Marriage Act that in the matrimonial disputes, preference shall be given to the wife with reference to the place of hearing, I am inclined to transfer H.M.O.P.No.278 of 2015 from the file of the Sub Court, Tambaram to the file of the Family Court at Cuddalore. The Family Court, Cuddalore is also directed to consider the request of the respondent / husband about the hearing dates to be fixed on Saturdays as he is employed in IT Sector.
