O R D E R
This petition has been filed seeking a direction to the respondent to register a case based on the complaint given by the petitioner dated 01.10.2015 and investigate the same in accordance with law.
2.It is represented that on 11.10.2015 a complaint has been lodged by the petitioner as against 1.Karthika, 2.Jamuna, 3.Sampath, 4.Arunprasad, 5.Somasundaram and five others stating that the said accused persons unlawfully trespassed into the petitioner's property and also threatened the petitioner. Since the respondent has not taken any action, the petitioner has filed the present criminal original petition. https://hcservices.ecourts.gov.in/hcservices/
3.Today, when the matter was taken up for consideration, learned Additional Public Prosecutor submitted that on the basis of the complaint given by the petitioner, a case was already registered in Crime No.728 of 2015 for the offences punishable under Sections 147,447,323, 506(ii) IPC and the same is under investigation.
4.Since a case was already registered on the basis of the complaint given by the petitioner, the prayer that has been made in the present petition has become infructuous. Hence, the criminal original petition is closed.
