Respondent Prayer:- Writ petition filed under Article 226 of the constitution of India praying for a writ of Mandamus directing the respondent to consider the petitioner's representation dated 01.01.2015 to register her date of birth in the birth register maintained by the Corporation of Chennai and consequently issue birth certificate to the petitioner.

ORDER

The petitioner contends that she was born on 25.03.1989 and she alongwith her elder sister were deserted by her parents and they are being looked after by her grandparents. Since the parents deserted the petitioner and her sister, the petitioner is unable to verify whether her birth was registered and the petitioner wants to register her birth and also requires birth certificate for the purpose of getting passport to go abroad. In this regard, the petitioner has given a representation on 01.01.2015 to the respondent to register her date of birth in the register maintained by the Corporation of Chennai and consequently, issue birth certificate to that effect.

2. Heard Mr.A.P.Surya Prakasam, learned counsel appearing for the petitioner and Mr.P.V.Selvakumar, learned counsel appearing for the respondent.

3. There is no necessity for the respondent to conduct any enquiry in this matter as the petitioner's date of birth is reflected in her SSLC mark sheet itself as 25.03.1989. Only when the petitioner wants to change the date of birth which has been shown in the school records, an enquiry has to be conducted. The petitioner representation is that her birth to be registered and birth certificate to be issued to her as per the date of birth shown in the educational records. There should not be any problem for the respondent as it is evident from the SSCL mark sheet as well as HSC mark sheet presented by the petitioner.

4. In view of the above circumstances, the respondent is directed to enter the date of birth of the petitioner as 25.03.1989, as per the school records and issue birth certificate to her, within a period of four weeks from the date of receipt of a copy of this order.

5. The writ petition is disposed of with the above direction. No costs.
