O R D E R
This Writ Petition has been filed challenging the order dated 27.08.2016 passed by the second respondent, thereby rejecting the request made by the petitioner seeking transfer from the post Lab Assistant to the Junior Assistant.
2. Heard the learned counsel for both sides and perused the materials available on record.
3. This Writ Petition has been filed after a lapse of 8 years from the date of the impugned order. Further, as on the date of the impugned order, there was no vacancy in the post of Junior Assistant and the post of Junior Assistant, which is a higher post. It has now been clarified by the Hon'ble 3/7
Division Bench of this Court that the posts of Lab Assistant and Junior Assistant fall under the same scale of pay and the post of Junior Assistant is not a promotional post. However, the post of Junior Assistant is feeder category for promotion to the post of Assistant. The post of Lab Assistant is not a filter category for any promotion.
4. In view of the above, the petitioner is directed to submit a fresh representation to the respondents seeking transfer from the post of Lab Assistant to the Junior Assistant. On receipt of such representation, the respondents are directed to consider the same and pass appropriate orders on merits and in accordance with law, subject to the availability of vacancies are available in the post of Junior Assistant.
5. With the above directions, this Writ Petition is disposed of. 4/7
