This petition is filed to withdraw H.M.O.P.No.218 of 2017 on the file of the District Court, Thiruvallur and transfer the same to the file of the District and Sessions Court, Kanyakumari at Nagercoil, to try along with I.D.O.P.No.318 of 2016 pending on its file.

2.The learned counsel for the respondent submitted that H.M.O.P.No.218 of 2017 filed by the respondent was dismissed for default on 13.03.2018 and therefore, the present transfer petition has become infrcutuous.

3.In view of the submission made by the learned counsel for the respondent, the Transfer Civil Miscellaneous Petition is dismissed. It is open to the petitioner to file a fresh transfer petition, if H.M.O.P. is restored to file. No costs.
