Prayer : Arbitration Original Petition (Commercial Division) filed under Section 11(6) of the Arbitration and Conciliation Act, 1996 read with Section 2 (C)(vi) of Commercial Courts Act, 2015, praying to appoint an arbitrator to adjudicate the disputes between the parties viz., the disputes concerning the matters touching upon the Construction Agreement dated 10.04.2023 and pass such further or other orders as this Court may deem fit and proper in the circumstances of the case. A joint endorsement has been made by both the counsels on instructions that the petitioner and the respondent have agreed for the appointment of Mr.J.V.Raj, Retired District Judge to act as the sole arbitrator to adjudicate the dispute between the petitioner and the respondent arising out of the Construction Agreement dated 10.04.2023 entered into between the petitioner and the respondent.

2. In view of the joint endorsement made, this Court is appointing Mr.J.V.Raj, Retired District Judge having his residence at No.46, Sathya Nagar, Near Reeds School, Mylampatti, Coimbatore - 641 062 as the sole Arbitrator to adjudicate the dispute between the petitioner and the respondent arising out of the Construction Agreement dated 10.04.2023 entered into between the petitioner and the respondent.

3. The Arbitrator shall be paid his remuneration / fees in accordance with the 4th schedule of the Arbitration and Conciliation Act, 1996. Both the parties shall equally share the arbitrator's fees. The Arbitrator shall conduct the arbitration in accordance with the provisions 2/4

of the Arbitration and Conciliation Act, 1996 and shall complete the arbitration within the specified time as prescribed under the said Act. 17.06.2025 Index: Yes/ No Speaking order / Non speaking order Maya 3/4
