ORDER

This petition is filed seeking to issue a Writ of Certiorarified Mandamus, call for the records of the 2nd respondent in Proce.No.1242/A3/2024 dated 01.04.2024 and quash the same consequently direct the respondents to permit the petitioner to retire from service as on 31.05.2024.

2. The facts of the case is that the petitioner worked as Secondary Grade Teacher in the second respondent's office and superannuated on 31.05.2024. The grievance of the petitioner is that the the second respondent vide impugned proceedings 1242/A3/2024 dated 01.04.2024 placed him under suspension on the ground he has produced a false educational certificate. Aggrieved over the same the petitioner has come up with this petition.

The learned counsel for the petitioner submitted that the petitioner obtained Diploma in Teacher's Education from Annai Therasa Teacher Education Institute, Cheyyar, Vellore District which is approved by the Civil Appeal No.1914 of 1987. It is pertinent to note that the said degree was recognized and the same was registered with Registered No. 406277/90, Roll No.29602 dated 13.07.1987. He further submitted that when earlier the petitioner requested the first respondent to issue the genuineness of his certificate, who without giving a copy passed the impugned order. Hence prays to allow this petition.

The learned special Government pleader appearing for the respondents would submit that the petitioner's certificate which sent on genuineness verification has been placed before the competent authorities wherein it is found that the signature of the Secretary of Director of Government Examinations affixed in the certificate entirely differs from the facsimile signature of the concerned officer of Directorate of Government Examinations. It is pertinent to note that the Diploma certificate of the petitioner issued in the year 1988 was received on 1985 3/6

from State Government wherein it is printed as 2003- 13-5-85 left hand side corner of the certificate from the year 1989 Diploma Certificate which received on 1988 from State Government press has been printed as 20,003-9-5-88 on the left corner of diploma certificate.

5. Heard both sides and perused the materials available on record.

6. On a perusal of records, it is seen that the petitioner alleged to have produced bogus certificates. Hence, the second respondents have initiated proceedings against the petitioner under 17(e) of Tamil Nadu Civil Services (Discipline and Appeal) Rules in Proc.No.1242/A3/2024 on 01.04.2024 and placed him under suspension. It is also found that the charge sheet has been framed against him.

5. Considering the facts and circumstances of the case and the submissions made by either side this Court directs the respondent to proceed with the enquiry in the manner known to law after providing an opportunity of personal hearing and complete the enquiry on or before 4/6

May 31 of 2025. The petitioner is directed to co-operate with the enquiry and adduce all the relevant documents to the respondent.

6. With the above observations, this writ petition is dismissed. No order as to costs. Consequently, the connected writ miscellaneous petitions are closed.
